Legislation Changes Alberta OHS Act December 1, 2021

The updated act eliminates duplication and simplifies language. This makes OHS laws easier to understand and follow, resulting in healthier and safer workplaces and supporting investment attraction and job creation.
OHS Act clarifies what a potentially serious incident is and streamlines reporting requirements. Reporting of potentially serious incidents remains mandatory. However, the act now allows a one-step process where investigation reports are submitted once complete, with no initial reporting required.
The act also clarifies the two criteria that define reportable potentially serious incident. These are:
  • The incident had a likelihood of causing a serious injury or illness.
  • There is reasonable cause to believe that corrective action may be needed to prevent recurrence
